Do you need to modify child support if your income has been reduced?
If your income has been substantially reduced, a motion must be filed. The Court will not automatically review your child support without the appropriate motion on file. The time period from when you file until the hearing or setting on the motion is important. There is not an automatic mechanism for the child support to be reviewed.
Your income may be restored by the hearing date, but you can still request for a modification for the timeframe it was reduced. Both parties’ incomes will be reviewed to determine whether the support amount should be modified. The order may be temporary so that when income changes again, the amount can be adjusted, if appropriate.
